Simulated e-Discovery “Meet & Confer” Before Judge Shira A. Scheindlin

Ken Withers, Senior Judicial Education Attorney for the Federal Judicial Center, introduces the hypothetical he developed that serves as a backdrop for the mock exercise. The City of Pleasantville is represented by Chicago attorney Mary M. Rowland of Hughes Socol Piers Resnick&Dym, Ltd. She has also been appointed as Liaison Counsel for the purposes of this proceeding, standing in for the numerous local attorneys who represent individual plaintiffs, including a team of pro bono attorneys volunteering for a local environmental group. Mary is accompanied by her technical advisor, Craig D. Ball, a board certified trial lawyer and certified computer forensic examiner. Global Chemical Corporation, Bugacide’s parent, is represented by Chicago attorney Thomas A. Lidbury of Drinker Biddle &Reath,LLP. Tom is likewise accompanied by his technical advisor, John Jessen, of Jessen & Associates. Following a FRCP 26(f) “meet & confer,” the dispute reaches its crescendo as the parties appear before United States District Judge Shira A. Scheindlin.
